It is unlawful for any person to waste irrigation system water willfully. Waste shall be determined by the division manager through reference to the actual need for irrigation water on the premises and the methods of use, delivery, and application of irrigation system water by others in the vicinity. The division manager shall issue a notice of determination of waste to the property owner by registered mail to the billing address. The property owner shall have fourteen days (excluding Sundays and legal holidays) from the date of mailing of such notice to terminate the waste. Within one hundred eighty days of the effective date of the ordinance codified in this chapter, the division manager shall make a recommendation to the council regarding standards for the determination of waste.
